CONTRACT CONDITIONS
1. Standard of Work
The Consultant will carry out the work with due diligence and in accordance with Australian Standard AS4349.1
2. Payment by Client
The Client will for this purpose be the party who requires the Consultant to do the inspection and report. The Client must pay the inspection and report fee which covers all matters reasonably necessary for the completion of the work.
The fee is to be paid prior to the report being released and no later than two (2) working days after notice from the Consultant that the work has been completed
3. Time for Completion
The Consultant is entitled to a reasonable extension of time when delays to the work are caused by events or matters beyond the Consultant‘s control including weather or delay in or an inability to get access to the property.
4. Warranty
The Consultant warrants that the report identifies the conditions of the property inspected as of the date of inspection and is restricted to those areas of and aspects of the property which were accessible and able to be reported on.
5. Access to the Property to be Inspected
The report is based on a visual inspection. A visual inspection does not allow the Consultant doing the inspection to gain access to parts of the property which are not freely and without restriction accessible. Certain parts of the property will be inaccessible due to:-
lack of access for the Consultant; being covered or hidden by the occupant‘s material including furniture, floor coverings, material stored in the property and concealed by reason of work, actions or efforts of the then owner or occupant (or their agents) such as painting of walls, locking of doors or placement of material or goods which cannot be removed or moved without physical exertion and the owner or occupant‘s specific permission.
6. Completion of Inspection
At completion of the inspection of the property the Consultant will prepare a report about the property in accordance with AS 4939.1. Upon payment of the fee the report will be released to the Client.
7. Exclusions
Unless the report specifically refers to and mentions aspects of a property‘s characteristics, structure or services including water, gas, electricity, heating, cooling or their fitness for purpose any such characteristic, structure or services is not validated or warranted by the said report.
